Terms of Service

These Terms of Service ("Terms") govern your use of CPV FitLab's website and client tracker application, and your enrolment in any CPV FitLab coaching plan (together, the "Services"), provided by CPV FitLab under the coaching leadership of CP Sharma ("CPV FitLab", "we", "us"). By creating an account or enrolling in a plan, you ("you", "client") agree to be bound by these Terms.

CPV FitLab is the trade name under which CP Sharma operates as an individual proprietor. It is not currently a separately registered company, LLP, or other corporate entity. CP Sharma is the sole party responsible for the Services and is who you are contracting with. Payments for coaching plans are received directly to CP Sharma's personal PhonePe/UPI account, so a transaction or bank statement may show his name rather than "CPV FitLab."

1. The Services We Provide

CPV FitLab provides online personal fitness coaching, including personalised workout and diet plans, progress tracking through our client tracker application, and periodic check-ins with your assigned coach. Our current plans include the Basic, Silver, and Premium (12-Week Protocol) individual coaching plans, 1:1 session-based coaching packages, and Corporate Wellness programs for organisations. The exact features, duration, and check-in frequency of your plan are as described to you at the time of enrolment.

2. Eligibility and Account

• You must be at least 18 years old to use our Services.
• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Accounts are personal and non-transferable, and are intended for use on one device at a time.
• You agree to provide accurate information about your health, fitness history, and goals, since your plan is built around what you disclose.

3. Health and Medical Disclaimer

CPV FitLab provides fitness and nutrition coaching, not medical advice. You should consult a qualified physician before beginning any new fitness or diet program, particularly if you have any pre-existing medical condition, injury, or health concern. You are responsible for informing your coach of any relevant medical conditions before starting your plan. See our Disclaimer for full details.

4. Client Responsibilities

Coaching is a two-way process. To get the results your plan is designed for, you agree to follow your assigned workout and diet plan in good faith, log your progress honestly and regularly in the tracker, attend scheduled check-ins, and communicate promptly with your coach about any difficulty, discomfort, or change in circumstances.

5. Payments and Plans

Fees for your chosen plan are payable as agreed at the time of enrolment. Plan pricing, inclusions, and duration are as communicated to you before payment. Payments are processed through third-party payment channels; CPV FitLab does not store your card or bank details.

6. Refunds and Cancellations

Our refund and cancellation terms are set out in full in our separate Refund & Cancellation Policy, which forms part of these Terms.

7. Progress Photos and Content

Any progress photos, measurements, or other content you submit through the tracker remain yours. We use this content only to deliver your coaching plan, as described in our Privacy Policy, and will never use it publicly without your separate, explicit consent.

8. Termination

You may stop using the Services at any time by contacting your coach. CPV FitLab reserves the right to suspend or terminate an account for misuse of the Services, non-payment, or conduct that is abusive towards our coaching staff.

9. Limitation of Liability

To the maximum extent permitted by law, CPV FitLab and CP Sharma shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Services, including any injury resulting from failure to follow your plan as instructed, failure to disclose a relevant medical condition, or failure to consult a physician where advised.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts having competent authority over CPV FitLab's place of business.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate, by notifying active clients directly.
